USA Express is an online retail business offering authentic
U.S.-sourced products to customers in the Philippines.
Products may include snacks, pantry items, beauty and
personal-care products, fashion and accessories, household items, seasonal
products, limited releases, and other general merchandise.
Product selection may change frequently depending on
sourcing availability, travel schedules, retailer inventory, customer demand,
and USA Drop availability.
You may use the USA Express website only for lawful purposes
and in accordance with these Terms.
You are responsible for ensuring that the information you
provide to us is accurate, complete, and current.
You may not use the website to engage in fraud, abuse,
unauthorized access, interference with the store, scraping, automated
purchasing activity, or any unlawful conduct.
We make reasonable efforts to present product descriptions,
images, sizes, colors, ingredients, features, packaging, and other product
information accurately.
However, packaging, labeling, colors, product appearance,
and other details may vary from photographs or change without notice due to
manufacturer updates, retailer changes, seasonal packaging, or other factors
outside our control.
Customers are responsible for reviewing product information
carefully before purchase, including ingredients, allergen information, sizing,
usage instructions, and other details relevant to their individual needs.
USA Express is built around authentic sourcing from trusted
U.S. retailers, brands, and suppliers.
Where practical, we may provide information about sourcing,
retailer origin, USA Drops, or product provenance.
Sourcing information is provided for transparency and does
not imply affiliation, sponsorship, endorsement, or authorization by any
retailer or brand unless specifically stated.
Many USA Express products are available in limited
quantities.
Products shown as in stock may sell out quickly,
particularly items included in USA Drops, seasonal releases, limited-edition
collections, or hard-to-find products.
Adding an item to your cart does not guarantee availability
until the order is successfully placed and accepted.
We may limit quantities per customer or order where
reasonably necessary to manage limited inventory, prevent abuse, or ensure fair
access.
USA Drops and Just Landed collections are merchandising
features used to highlight newly sourced, limited, seasonal, or recently
arrived products.
Unless explicitly stated otherwise, an upcoming item,
waitlist listing, teaser, or pre-arrival product is not a guarantee that the
item will be available for sale.
Availability may change because of sourcing conditions,
retailer stock, shipment delays, customs or logistics issues, damaged
inventory, or other circumstances.
The Request an Item feature allows customers to suggest
products they would like USA Express to source.
Submitting a request does not create a purchase agreement,
reservation, pre-order, guarantee of sourcing, or obligation for USA Express to
obtain the requested item.
We may use request information to evaluate demand, sourcing
opportunities, and future USA Drops.
If we source a requested product, pricing, availability,
quantity, and purchase terms will be determined separately at that time.
All prices displayed on USA Express are subject to change
without notice.
Prices may reflect sourcing costs, currency movements,
freight, logistics, handling, limited availability, retailer pricing,
promotions, and other commercial factors.
USA Express is not required to match U.S. retail prices,
Philippine marketplace prices, competitor prices, historical prices, or prices
offered by third-party sellers.
We reserve the right to correct typographical errors, incorrect
prices, product-information errors, inventory errors, promotional errors, or
other mistakes at any time.
If an order is affected by a material pricing or listing
error, we may contact you, correct the order, or cancel and refund the affected
item as appropriate.
Submitting an order does not guarantee acceptance.
USA Express reserves the right to refuse, limit, hold, or
cancel an order where reasonably necessary, including in cases involving
suspected fraud, payment issues, inventory errors, pricing errors, abusive
activity, unusual order quantities, delivery limitations, or other legitimate
business reasons.
If we cancel an order after payment has been successfully
collected, the applicable amount will be refunded or otherwise resolved
appropriately.
Orders cannot be cancelled or modified after they are
placed.
Customers are responsible for reviewing products,
quantities, delivery details, contact information, and payment information
before completing checkout.
This rule does not limit any rights or remedies that cannot
legally be excluded under applicable consumer law.
Payment methods available at checkout may include GCash,
Maya, Philippine credit or debit cards, bank-transfer options, or other payment
methods supported by our payment providers.
Payment processing is handled through Shopify and/or
approved third-party payment providers.
You agree to provide valid payment information and authorize
the applicable payment provider to process the amount due for your order.
USA Express may delay fulfillment while payment
verification, fraud screening, or other payment-related checks are completed.
Shipping availability, processing, rates, tracking, and
delivery estimates are described on our Shipping Info and Shipping Policy
pages.
Delivery dates are estimates rather than guarantees unless
expressly stated otherwise.
USA Express is not responsible for delays caused by
couriers, weather, regional disruptions, incorrect addresses, recipient
unavailability, government action, or other circumstances outside our
reasonable control.
Customers are responsible for providing complete and
accurate delivery information.
Returns, refunds, replacements, store credits, claim
requirements, and the 48-hour reporting period are governed by our Returns
& Refunds page and Refund Policy.
Those policies form part of these Terms.
Where a conflict exists between general website language and
a specific returns or refund policy, the more specific policy will apply,
subject to applicable law.
Customers may be able to submit reviews, ratings, photos,
messages, product requests, or other content.
By submitting content, you confirm that you have the right
to provide it and that it is not unlawful, fraudulent, defamatory, abusive,
misleading, infringing, or otherwise inappropriate.
We may moderate, remove, refuse, or restrict customer
content where reasonably necessary.
Where permitted by law, you grant USA Express a
non-exclusive, royalty-free license to use customer-submitted reviews, photos,
or comments for store operation, customer support, and marketing purposes.
Promotions, discount codes, shipping offers, giveaways,
limited-time deals, or other incentives may be subject to separate terms.
Unless stated otherwise, promotions may not be combined, may
have eligibility requirements, may be limited in quantity or duration, and may
be modified or withdrawn where reasonably necessary.
Promotional misuse, duplicate-account abuse, automated use,
or other manipulation may result in cancellation of the promotion or affected
order.
If customer accounts are available, you are responsible for
maintaining the confidentiality of your account credentials and for activity
conducted through your account.
You should notify us promptly if you believe your account
has been compromised.
We may suspend or restrict accounts involved in suspected
fraud, abuse, security threats, or violations of these Terms.
The USA Express name, logo, website design, graphics, text,
photographs, illustrations, custom sections, branding, and original website
content are owned by or licensed to USA Express and are protected by applicable
intellectual-property laws.
You may not copy, reproduce, republish, distribute, modify,
scrape, commercially exploit, or create derivative works from USA Express
content without permission, except as permitted by law.
Third-party product names, logos, trademarks, and images
remain the property of their respective owners.
USA Express may use or link to third-party services, including
Shopify, payment providers, couriers, email providers, review tools,
social-media platforms, analytics providers, and other applications.
Third-party services are governed by their own terms,
policies, availability, and practices.
USA Express is not responsible for the operation, content,
security, availability, or policies of third-party services that we do not
control.
You may not use USA Express to engage in fraudulent
purchases, payment abuse, chargeback abuse, unauthorized account access, data
scraping, malware activity, interference with the website, resale schemes that
violate applicable law, harassment, or any activity intended to harm USA
Express, its customers, service providers, or systems.
We may restrict access, cancel orders, suspend accounts,
preserve records, or take other reasonable action in response to suspected
prohibited conduct.
To the fullest extent permitted by law, the website and
services are provided on an 'as available' basis.
We do not guarantee that the website will always be
uninterrupted, error-free, secure, or free from technical issues.
Manufacturer warranties, if any, are provided by the
applicable manufacturer and are not expanded by USA Express unless expressly stated.
To the fullest extent permitted by applicable law, USA
Express will not be liable for indirect, incidental, special, consequential,
exemplary, or punitive damages arising from use of the website, delayed
delivery, unavailable products, third-party services, or other matters outside
our reasonable control.
Where liability cannot legally be excluded, our liability
will be limited only to the extent permitted by applicable law.
Nothing in these Terms excludes liability or consumer rights
that cannot legally be excluded.
To the extent permitted by law, you agree to indemnify and
hold harmless USA Express from claims, losses, liabilities, or expenses arising
from your unlawful use of the website, violation of these Terms, infringement
of another person's rights, fraudulent activity, or misuse of USA Express
services.
Your use of USA Express is also governed by our Privacy
Policy, which explains how personal information may be collected, used, shared,
and protected.
USA Express may change, suspend, discontinue, add, or remove
products, features, services, collections, website functionality, or store
policies from time to time.
We may also update these Terms when our business, services,
technology, or legal requirements change.
We may revise these Terms of Service from time to time.
Updated Terms will be posted on the website with a revised
update date.
Continued use of USA Express after updated Terms become
effective constitutes acceptance of the revised Terms to the extent permitted
by law.
If any part of these Terms is found to be invalid, unlawful,
or unenforceable, the remaining provisions will continue in effect to the
fullest extent permitted by law.
If USA Express does not immediately enforce a provision of
these Terms, that does not mean we waive the right to enforce it later.
These Terms are intended to operate in accordance with applicable
laws governing USA Express and transactions with our customers.
Mandatory consumer-protection rights and other legal
requirements that cannot be excluded will continue to apply regardless of
anything stated in these Terms.
